Drift Terms of Use

Welcome to Drift. These Terms of Use ("Terms") are a binding agreement between you and the operator of the Drift mobile application and related services ("Drift," "we," "us," or "our"). By downloading, installing, accessing, or using the Drift app or any related services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance and Eligibility
- Acceptance: By creating an account or using the Service, you confirm that you have read, understand, and agree to these Terms and to our Privacy Policy, which is incorporated by reference.
- Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into these Terms. The Service is intended for the van life, RV, and travel community. We may require invite codes or other eligibility steps to access certain features or the Service as a whole.
- Changes: We may update these Terms from time to time. We will post the revised Terms in the App and update the "Last updated" date. Your continued use of the Service after changes take effect means you accept the new Terms. For material changes, we may provide additional notice (e.g., in-app or by email) where required by law.
2. Description of the Service
Drift is a mobile application that helps users in the van life and travel community to:
- Discover and connect: Browse profiles, indicate interest (e.g., swipes/likes), form mutual matches, and connect as friends or for dating, according to your preferences and settings.
- Plan and join activities: Create and join in-person activities (e.g., meetups, campouts), see locations and details subject to privacy settings (e.g., exact location after joining), and coordinate with other attendees.
- Community and events: Post and join events, ask for or offer help (e.g., van build, mechanical), comment, like, and participate in group discussions and event chats.
- Messaging: Send direct messages and participate in activity- or event-based group conversations.
- Campground search: Search for campgrounds and check availability using data provided by our campground data partner (Campflare).
- Van Builder: Participate in builder-focused channels and content.
- Subscriptions: Optional paid subscription ("Drift Pro") that may unlock additional features, as described in the App and in Section 6.
We may add, change, or discontinue features or the Service at any time. We do not guarantee that any feature or the Service will be available in all regions or on all devices.
3. Account and Responsibility
- Account: You must provide accurate and complete information when you register and keep your account information up to date. You are responsible for all activity under your account and for keeping your credentials secure.
- One account: You may only maintain one account unless we expressly allow otherwise. Creating multiple accounts to evade rules or limits is prohibited.
- Verification: We may offer optional identity verification (e.g., selfie-based checks). Verification status may be displayed to other users (e.g., a "verified" badge). We do not guarantee the accuracy of verification or that every user will be verified.
4. Conduct and Content
4.1 Rules of Conduct
You agree not to:
- Violate any applicable law or encourage others to do so.
- Harass, bully, threaten, stalk, defame, or intimidate any person.
- Post content that is illegal, harmful, abusive, hateful, discriminatory, sexually explicit, or that promotes violence or self-harm.
- Impersonate any person or entity or misrepresent your identity or affiliation.
- Spam, phish, or use the Service for fraud or unauthorized commercial solicitation.
- Scrape, reverse-engineer, or automate access to the Service or user data except as permitted by us.
- Circumvent safety or access controls (e.g., blocking, reporting, invite requirements, or age restrictions).
- Interfere with or disrupt the Service or our systems, or attempt to gain unauthorized access to them or to other users' accounts.
4.2 Your Content
You retain ownership of content you post. By posting content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, display, reproduce, and distribute that content as needed to operate and promote the Service (e.g., showing your profile and posts to other users, backing up data, improving the product). This license continues for content that remains on the Service and for a limited time after removal as needed for backup, legal, or safety purposes.
You represent that you have all rights needed to post your content and that it does not infringe anyone else's rights. We may remove or refuse to display any content that we believe violates these Terms or is harmful, with or without notice.
4.3 Blocking and Reporting
- Blocking: You may block other users. Blocked users typically cannot contact you or see certain parts of your profile; specific behavior is defined in the App.
- Reporting: You may report content or conduct that you believe violates these Terms or is harmful. "Report" may be available in-product before full moderation flows are implemented. We will use good-faith efforts to review reports and take action where appropriate. We are not obligated to take any particular action or to disclose our decisions.
5. Privacy
Your privacy is important to us. Our Privacy Policy describes what data we collect, how we use and share it, and your rights. By using the Service, you consent to the practices described in the Privacy Policy.
6. Subscriptions and Purchases (Drift Pro)
- Offers: Drift Pro is a subscription that may include monthly and/or yearly options, free trials, and other offers as shown in the App. Prices and terms are displayed before purchase.
- Billing: Subscriptions are billed through the Apple App Store. Payment is subject to Apple's terms and conditions. We do not store your full payment card details.
- Renewal and cancellation: Subscriptions renew automatically until you cancel. You may cancel or manage your subscription in your device's App Store subscription settings. Cancellation stops future charges but does not refund any period already paid.
- Refunds: Refund requests for subscriptions are handled by Apple in accordance with Apple's policies. We do not guarantee refunds. If Apple makes an exception and refunds you, we may revoke access to Drift Pro for the refunded period.
- Changes: We may change subscription prices, plans, or features with notice where required by law. Continued use after a change may constitute acceptance of the new terms for future renewal periods.
7. Third-Party Services and Links
The Service may use or link to third-party services (e.g., Supabase, RevenueCat, Campflare, Firebase, verification providers, Apple). Your use of those services is subject to their terms and privacy policies. We are not responsible for their practices, content, or availability.
8. Disclaimers
- "As is." The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- No advice. We do not provide legal, safety, medical, or travel advice. Meeting others in person, attending events, or traveling involves risk. You are responsible for your own safety and decisions.
- Content and conduct. We do not endorse and are not responsible for any user content or conduct. You interact with other users at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law:
- We and our affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, or goodwill) arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
- Our total liability for any claims related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you. In such cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Drift and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your content or conduct; (c) your violation of these Terms or any law; or (d) your violation of another party's rights.
11. Termination
- By you: You may stop using the Service at any time and may delete your account through the App or by contacting us.
- By us: We may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason we deem appropriate (e.g., safety, fraud, abuse).
- Effect: Upon termination, your right to use the Service ends. Sections that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification, dispute resolution) will survive termination.
12. Disputes and Governing Law
- Governing law: These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
- Informal resolution: Before filing a formal dispute, you agree to contact us at support@usedrift.app and attempt to resolve the dispute informally for at least 30 days.
- Class action waiver: To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.
13. General
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Drift regarding the Service and supersede any prior agreements.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment: We may assign these Terms or our rights under them. You may not assign your rights without our written consent.
